Garrett G. v. Houston Independent School District

The Houston Independent School District failed to provide Garrett who has autism the appropriate services to obtain a free and appropriate public education. HISD failed to develop an individualized educational plan for Garrett.  Furthermore, HISD failed to collect data properly to track Garrett’s academic and behavioral progress.

As a result of these shortcomings, Garrett’s parents had to put him in a private school.  In 2012, Whitburn & Pevsner filed an administrative Due Process complaint against HISD.  We prevailed against HISD.  The hearing officer ordered HISD to reimburse the parents of Garrett for private placement, to consult with Garrett’s private therapists and to develop an appropriate individualized educational plan tailored to Garrett’s unique needs.
