Barbara Harrison v. Courtney Phillips

Whitburn & Pevsner, PLLC convinced a US District Court in the Northern District of Texas that the State of Texas violated Title II of the Americans with Disabilities Act (“ADA”) as interpreted in the US Supreme Court’s Olmstead decision.   In this case, the Texas Health and Human Services Commission (“HHSC”) attempted to place our client with intellectual and physical disabilities in an institution without complying with the Olmstead decision.  The US District Court found that HHSC violated the rights of our client under the ADA and ordered HHSC to continue funding her care in the community group home.
